[All] Official Plans Reversal Reversals, Greenbelt ERO Response Deadline, and Bill 23 Updates

Good Day!

We continue to make good progress but there’s lots we need to be speaking up about over the next few weeks:

1) Province Tables Legislation Cancelling Forced Urban Boundary Expansions - On Thursday, Minister of Municipal Affairs and Housing Paul Calandra introduced the legislation that scraps the Official Plan changes that former Minister Steve Clark used to force tens of thousands of acres of unnecessary and unwanted farmland destruction on the Region of Waterloo, Wellington County, Halton Region, Hamilton, Ottawa, and other municipalities.  These Ministry orders severely compromised these 30 year future plans with no data, rationale or justification provided by the provincial government and in light of the Greenbelt Scandal it seems that many decisions were made by Conservatives to please developers and donors.

As great as it is to see this reversal legislation - which we will need to review carefully to ensure that it is doing what is intended and doesn’t contain loopholes or other concerns, we have to remember that Minister Calandra is now trying to simultaneously bring back these Forced Boundary Expansions by downloading the decisions and responsibility on lower-tier municipal Mayors who are now facing intense developer pressures to respond to the Minister personally by December 7th to see these lands re-designated back to development lands in Official Plans - still with no study, data, rationale, or proper land needs analysis.

2) Forced Urban Boundary Reversal Reversals - It seems that most area Mayors aren’t falling for the unilateral decision-making powers that Minister Calandra gave them on November 2nd but have asked for Staff Report's and are planning to bring this issue before their Councils prior to the December 7th deadline.  This is still very troubling as lower-tier municipalities don’t have Planning Authority for upper-tier land use plans (Regional Official Plans) or land needs assessment (LNA) expertise, nor do they have the broader regional perspective considering water sources, sewage capacities, road/transportation networks, hospital, and other significant considerations that need to be taken into account when planning growth over vast areas.

None of our Mayors or municipalities should be complicit in further the provincial developer scandals when the province still can’t even explain how these parcels were chosen and RCMP investigations are continuing.  We need to ensure that our municipalities avoid this provincial corruption, approve our Official Plans intact, and use proper planning processes over the years ahead to determine any additional land needs.  All our municipalities have already demonstrated they can meet their housing targets with existing land approvals and we still have decades of additional land supply already approved beyond that.  There is no urgency or need to bypass proper planning to further the corruption of this scandal-ridden provincial government.

Kudo’s to the City of Waterloo for unanimously passing a motion (attached below) raising concerns about the Minister’s approach and expressing strong support to see our Regional Official Plan proceed intact.  Please work with your local Council to see if they can pass a similar motion or at the very least don’t seek additional lands from the Minister furthering this corrupt scheme.

Unfortunately, already the Mayor of the Town of Milton has stated that he is falling for developer pressures and will join in the collusion with Queen’s Park by requesting these reversals be restored:

3) Minister Clark Is Now Deeply Remorseful - Thursday’s massive front-page headlines in newspapers across Ontario announced that Former Minister Steve Clark has emerged from months of hiding and is now speaking publicly about being “deeply remorseful” about the Greenbelt scandal that he denied, stonewalled, and ignored our concerns about for months.  Apparently he has yet to be contacted by the RCMP for interviews and internal party insiders state they feel that Clark was simply following orders and has been made a scapegoat.  We must keep the pressure on the Ford government for better future outcomes and corrections to many outstanding issues.

5) Greenbelt ERO Submissions - Greenbelt Promise is hoping to get 5,000 people to respond to the Environmental Registry of Ontario (ERO) calling for full and permanent protection of the Ontario’s Greenbelt.  November 30th is the deadline for submissions on this Bill 136 ERO so help spread the word and ensure that we have as many voices as possible speaking up for the full protection of the Greenbelt.  There’s an easy to use automatic tool on the Greenbelt Promise website to help draft submissions:

Key points to emphasize on Bill 136, the Greenbelt Statute Law Amendment Act include:

	- legislating that the 10 year Greenbelt Reviews can only add lands to the Greenbelt with no land removals or land swaps,
	- ensure meaningful First Nations consultation,
	- prohibit “Pay to Slay” that enables habitat destruction of species at risk in the Greenbelt,
	- prohibit the licensing of new aggregate extraction permits in the Greenbelt,
	- protect all Prime Agricultural lands in the Greenbelt through Conservation Easements,
	- end the grandfathering of previous zoning for development applications within the Greenbelt.

13) CELA Water Conversations Webinar - Line 5 Pipeline: A Disaster In The Making - Episode 7.0 of Water Conversations <https://cela.ca/water-conversations/>  about the Great Lakes and the Line 5 pipeline will take place on Wednesday, November 29th from 10:00am-12:00pm (ET). 

The Line 5 pipeline crosses through the heart of the Great Lakes, putting 84% of North America/Turtle Island’s freshwater at imminent risk. It has already spilled at least 4.5 million litres of oil; it’s not a matter of if another spill will occur, but when and how devastating it will be.  Anishinaabeg Tribes and First Nations across the Great Lakes are fighting to shut it down in the name of protecting water and life. Great Lakes environmental advocacy groups, grassroots groups, and human rights lawyers have joined Indigenous nations in the call for the closure of the pipeline.
