It is the ‘unequivocal opinion’ of environmental lawyer David Donnelly, that “Stratford Council has the complete authority without legal liability to deny Xinyi’s proposal for a $6 million cost sharing agreement”.  Donnelly, one of Canada’s leading environmental lawyers, stated this in a letter delivered to Mayor Dan Mathieson and Stratford Council this morning on behalf of Wellington Water Watchers, and a number of citizens of the City of Stratford.

Donnelly reinforced the demand of his community client stating “the City of Stratford must request that the Minister of Municipal Affairs revoke the Minister’s Zoning Order (“MZO”) permitting the Xinyi facility”.

Donnelly law sent a letter to Mayor and Council at the direction of Wellington Water Watchers in advance of the 7pm Tuesday December 8th, online community meeting at which David Donnelly is one of the featured speakers. The integrity of the MZO is now also in question. On December 2, 2020 a complaint was filed by J. Burch MPP urging the Ontario Integrity Commissioner to investigate if the Ford government's MZO forcing Stratford to accept a float glass factory violated the Lobbyists Registration Act. According to the letter, “Despite evidence of extensive collaboration between Xinyi, GSP Group and the provincial government over the two years prior to the MZO, the province’s lobbyist registry shows no record of registration by either Xinyi or GSP Group.” The integrity of the MZO and scheme to bring Xinyi to Stratford is now very much in question.
