It is the ‘unequivocal opinion’ of environmental lawyer DavidDonnelly, that “Stratford Council has the complete authoritywithout legal liability to deny Xinyi’s proposal for a $6 million costsharing agreement”.  Donnelly, one of Canada’s leadingenvironmental lawyers, stated this in a letter delivered to Mayor DanMathieson and Stratford Council this morning on behalf of WellingtonWater Watchers, and a number of citizens of the City of Stratford.

Donnelly reinforced the demand of his community client stating “theCity of Stratford must request that the Minister of Municipal Affairsrevoke the Minister’s Zoning Order (“MZO”) permitting the Xinyifacility”.

Donnelly law sent a letter to Mayor and Council at the direction ofWellington Water Watchers in advance of the 7pm Tuesday December8th, online community meeting at which David Donnelly isone of the featured speakers. The integrity of the MZO is now also in question. On December 2,2020 a complaint was filed by J. Burch MPP urging the OntarioIntegrity Commissioner to investigate if the Ford government's MZOforcing Stratford to accept a float glass factory violated theLobbyists Registration Act. According to the letter, “Despiteevidence of extensive collaboration between Xinyi, GSP Group and theprovincial government over the two years prior to the MZO, theprovince’s lobbyist registry shows no record of registration by eitherXinyi or GSP Group.” The integrity of the MZO and scheme to bringXinyi to Stratford is now very much in question.
