I received a very interesting email from the MNR today.
Allow me to give a bit of history on this.
I was a delegate of the Line 10 National Energy Board Hearings that took place in Hamilton on Oct. 18 and 19th. My affidavit regarded the fact Jefferson Salamanders were confirmed in the area of a proposed pipeline replacement and yet there was no critical habitat mapping done to prevent harm to specimens. I had maps and data from Enbridge to support the presence of these animals.
The NEB ruling is now given. The section of the ruling that allowed this work without critical habitat mapping is noted below in the attachments.
I made an inquiry with my local MPP asking if Hydro or the Municipality need to act in compliance with the Endangered Species Act because they are Provincial agencies signing off on work done on Provincial lands to give right of way so it would stand to reason we may need those maps for these permissions. They intend to install a new pipe in a Hydro Corridor between Copetown and Westover Ontario.
Today here is the response I got from the MNR Guelph Office. On one hand they confirm these animals are here on the other hand it states the conditions of the Species At Risk Act does not apply to non-Federal lands and the Endangered Species Act doesn't apply because this project falls under Federal Jurisdictional approvals.
It also appears that the Guelph MNRF are using discretionary power to negate the need to push for critical habitat mapping.
This isn't a reasonable way to protect Federally and Provincially recognized endangered species. According to the Environmental Bill of Rights if Provincially owned lands contain endangered species by law we the public deserve a say on the distribution of permits to permit harm to either species or habitats. In other words, your breaching my civil liberties as a concerned citizen to have a say on this project.
If Enbridge needs a permit for water taking for pipelines and that is allowed on the registry as seen here:

....I fail to understand why is there an exemption regarding the listing of projects that threaten Endangered Species on the EBR listing.
As a delegate I know of the confirmed presence of Jefferson Salamanders, Western Chorus Frogs and Brown Bats regarding the Line 10 protect. The only remedy for Brown Bats proposed at the hearing I witnessed, was the installation of bat boxes. There was no expansion of habitat or other measures taken. Enbridge deemed this was sufficient but failed to provide evidence to show this scheme would actually work. How can we analyse if the proposed remedy works without securing actual follow up studies to assure no net loss to species or their habitats?
I want a written response on exactly how Enbridge intends to protect these endangered animals. I want critical habitat mapping completed and I want to assure there is no net loss to specimens by assuring follow up studies are reasonably completed proving no net loss to either species or their habitats.
In my view without critical habitat mapping we don't even have a clue what the current existing populations are needing to be replaced. .

We note that your letter outlines concerns with the Enbridge Pipelines Inc. (“Enbridge”) Line 10 Westover Segment Replacement Project. We are aware that Line 10 is an interprovincial transportation undertaking falling within the federal Parliament’s exclusive jurisdiction pursuant to clause 92(10)(a) of the Constitution Act, 1867. As such, the federal government has jurisdictional authority, which means that theEndangered Species Act, 2007 (ESA) does not apply. The Ministry of Natural Resources and Forestry (“MNRF”) is not an approval agency for this project; however, Enbridge sought technical advice from the MNRF with the intent of meeting the purpose and objectives of the ESA by minimizing impacts to Species at Risk (SAR). MNRF does not generally support surveys for SAR where occurrences are already documented. For this reason, MNRF did not request that the proponent perform any additional surveys, nor does MNRF deem it necessary in this case. Regarding Canada’s Species at Risk Act (SARA), this legislation only protects Jefferson Salamander and Western Chorus Frog where they occur on federal lands. MNRF recommends contacting the National Energy Board for further information. I hope that the above information is of assistance.
