[All] CRAND: OMB costs of $110,000

Hi folks
Bad news for the folks at CRAND struggling to stop a quarry pit in New Dundee. Previously at the OMB they provided their affidavit evidence from a health expert to raise concerns of pit activity in an area already subject to harmful air quality. The OMB chair dismissed the evidence saying it was outside the scope of the hearing process and then sought to dismiss the case with costs.
After an unusually long delay, well over a year, the ruling did come in today and CRAND is being charged $110,000 for costs. Full text of the ruling is online here:

I am working with Temara Brown on this matter and we are seeking legal assistance. It is my hope that Ontario's Anti Slapp law can be applied because this group diligently followed protocol, they trusted their legal experts (One of them failed them by using his own discretionary powers to voice concerns beyond the scope of their own interest. He missed key deadlines and delayed response which hampered their efforts.) There was nothing frivolous or vexatious about the data they submitted or their concerns. It is my hope this situation can be remedied through the proper application of Ontario's new Anti Slapp law. We are contacting legal advisors today to see what our options at this point are.
