Hello

As a delegate of the Enbridge Line 9 pipeline reversal hearing at the NEB,  I want to inform you of the following evidence that was presented: 

-Enbridge only did a scope analysis on pumping stations. The rest of the pipeline was out of the scope of study. When people asked for data regarding the pipe they were told they were "fishing".  Essentially they only studied pipes on the lands of the pumping station itself with no regard for the totality of the system inspite of intention to change pressure, contents, direction of flow and function. 

-Enbridge states hydrostatic testing for pipeline integrity could cause damages so they don't want to do it. 

-According to Enbridge's own data, Line 9's highest pressure rate ever experienced with 666psi for 5 minutes in Cardinal. The data from ACCUFACTS reveals that the entire length has stress fractures and cracking communities, many with threshholds of 740 psi or lower. The current application is seeking to increase pressure from  750 psi to 1000psi. This report was cited by EQUITERRE as well as RISING TIDES.

-Stress cracks exists all along the line. Enbridge's  ILI tools are unreliable for reviewing these issues. 

-The Goodman report challenges the fiscal benefits of this report as presented by Equiterre

-Expert John Quarterly works with the British, US and Canadian Government TOP SECURITY Agencies as well as NASA and NOAA among others. He is an expert Engineer. He spoke saying Bitumen is a solid. It is asphalt. As it moves it vibrates due to varients of mass, it will be under pressure creating a vortex effect. It will be heated but external factors such as ice, water, heated areas will create variants in thermal pressure. As it passes over seismic areas in Ontario and Quebec it faces even greater risks of catastrophic failures.  Please read his report. It is CRITICAL to review his concerns. 

-The testimony of Algonquin to Adirondack (A2A) showed  that from Hilton to Cardinal is where they found the highest volume of structural integrity issues within the existing Line 9  ie: cracks, corrosion etc.  They didn't know why all these issues were happening in this small zone. Meanwhile as part of my presentation, I have a Natural Resources Canada Map showing that exact same area as an earthquake hotspot. To view seismic risks of Enbridge Line 9 area see attachment. 

Mr. Quarterly also states, SPILLS are finite with a beginning and end but leaks are more uncertain when it comes to start and finish times therefore it is reasonable to say Enbridge's SPILLS response is not legally the same as a LEAK response. Enbridge has no leak response plan nor do they have appropriate monitoring. Leaks exist and they are ongoing. 

- Landowners with leaks on their property are ignored by Enbridge. They are held liable if the spills go to other properties. If the well is abandoned, NEB has no jurisdictional powers to help them. They're simply stuck with it. The pipe has many leaks and Enbridge lacks technologies to detect. Ontario Pipeline Land Owners Association spoke of these issues. 


-Spills response time could take up to 6 hours before the line is shut off manually. That is deemed within Enbridge's acceptable time of response.


-Shut off valves can be 12 miles apart. If a rupture happens, the rest of the contents of the pipe will still actively discharge in spite of shut valves. 

-The existing line crosses over Finch Subway, goes by York University and goes under the fire station across the street from the University and the firemen state they didn't even know the pipe was there. Students at York said they want every student to be compensated in case spills disrupt their education. 55,000 people go to this school.

-Area land owners in Toronto said 1 billion insurance is too little when homes average a million each off Finch in Toronto.

-Enbridge admits in WRITING that they have NEVER reviewed one single treaty regarding Line 9. 

-Simcoe treaty: Written by King George was ignored. 

-There has NEVER been crown designated consultant to facilitate the First Nation's consultation process regarding Line 9 in spite of the fact it crosses 18 First Nations territories. 

-Technically the current pipe is proof that the NEB, the Crown and Enbridge illegally facilitated the installation of the  original pipe and committed a CHARTER VIOLATION due to the absence of First Nation's consent. The approval of Line 9 phase 1 from Sarnia to Westover was illegal too for the same reasons. This process will be illegal a third time again if approved. Evidence on this matter was presented by Rising Tides. 

Why didn't the GRCA  or municipalities review Enbridge's data regarding the Line 9 phase 1 reversal? They would have quickly seen the studies were only limited to pumping stations. Why on earth were our local engineers and hydrology staff not screaming at the top of their lungs for a proper EA?!

If you wish to read my affidavit specific to concerns regarding the Grand and Nith Rivers that was presented to the National Energy Board view the attachment. 

The original EA data for the pipe's original installation was incomplete. The NEB placed conditions of approval on structural issues regarding the pipe and there is no existing data to show the conditions were ever met. This is cited in the affidavit of DurhamCLEAR. 

We cannot afford to repeat the same issues as Line 6. Line 9 is it's sister pipe of the same era and structural issues. The PE tape used on Line 9 is no longer in use because it disbonds. It's not up to code to today's standards.

This pipeline must be closed. It poses a significant National Security Risk. The CROWN ITSELF and the NEB has violated law in it's original approval process. This pipeline is without consent. 

Using discretionary powers, the CROWN abolished the national security protection of the Navigable Water's Act Using discretionary powers without reasonable evidence to support or without First Nation's Concent.

Enbridge negated informing municipalities about the risks of the pipeline reversal when it chose to use discretionary powers to negate their participation by limiting the scope of the EA. This in my view shows the intent to circumvent a reasonable EA process and therefore in my view constitutes as an act of TERRORISM against the members of the Canadian public, municipalities as well as our First Nation's Communities. 

Please be informed I have just filed a formal report with CSIS in regards to this matter and I pray to God there will be an appropriate investigation into this matter.

May the love of God be with us all as we seek to protect and preserve Ontario's waterways, First Nation's communities and municipalities from this diabolical act of domestic terrorism.
