The Jefferson Salamander is protected by the Species At Risk Act (SARA) which is the jurisdiction of Environment Canada . They are also protected by the Provincial Fish and Wildlife Conservation Act and the Ontario Endangered Species Act which is the jurisdiction of the Provincial MNR.  
 
The Provincial Planning Policy 2005 affords protection for Jefferson Salamanders in section 2.1.3 which prohibits development in the habitats of threatened species while in section 2.1.6 it states development and site alterations are not allowed if it will harm threatened species or their habitats on adjacent properties. 
 
Even with a kill permit for Jeffersons onsite, if Jeffersons on the adjacent lands use areas of the  Hanlon Business Park as a migratory route, they still cannot build there and by law, they cannot harm, disturb or kill the critters next door.  
 
To comply to the Species at Risk Act and Provincial Planning Policy a reasonable delineation of critical habitat must be established BEFORE further land augmentations take place. Justice Grey secured that.
 
In my view, a kill permit request made prior to the establishment of the critical habitat may be viewed as illegal and/or contempt of court because it shows the intent to violate the above laws prior to the establishment of any reasonable habitat delineation or recovery strategy.
