<table cellspacing="0" cellpadding="0" border="0" ><tr><td valign="top" style="font: inherit;">Greg I absolutely agree with you. We must be supportive of the Region's efforts 100%. Letters to the editors and public awareness campaigns on this matter is very much needed in order to help direct this issue towards a path of success. <br><br>I will contact the Regional staff and try to get a hold of the dates and times for these OMB hearings and I'll foward to GREN for their info. We'll stay on top of this. I do support the idea of an official letter of support from GREN. <br><br>Worst case scenerio, should the Region lose at the OMB re:aggregates etc. and there are measurable damages are done to our aquifers it gives us a strong case example to bump up the need for water/aggregate protection policy at the provincial/national level. <br><br>Should the Region win at the OMB, which is likely to happen in light of recent rulings that favor source protection
over aggregate interests, this could dramatically escalate the advances towards meaningful source water protection for the moraine. In this case the OMB may in fact be the greatest blessing ever. <br><br>The reason the province could not commit to a Waterloo Moraine Protection Act was due to the overwhelming amount of lawsuits they would face if they did support it. They don't have the staff or economic resources to deal with that but they did request that David Wellhauser and I to continue the dialogue with them in order craft our solutions that could be crafted into the revised Provincial Policy Statement. The unique blessing about these OMB processes is that by way of the OMB ruling, the province could in theory secure a bona fide way to protect our moraine while circumventing the associated legal risks. The OMB may have the power to mandate rulings that would accelerate the establishment of a Waterloo Moraine Protection Act.
<br><br>Right now, the greatest thing we can do is to bump up the public knowledge and opinion on this matter which is why I am planning on booking a facility to showcase a lecture on the Waterloo Moraine in the very near future. <div>The Region is to be commended for its appeal regarding aggregate extraction regulations. It has attempted to bring in more progressive and ecologically sound procedures and regulations, but has been beaten back by the Ministry of Natural Resources' stubborn
defence of the status quo. The Region of Waterloo was the first municipality to get its new official plan approved by council - and the last to get its approval back from the provincial government which was trying to delete or modify the Region's more enlightened
positions on aggregates. I think GREN should write a letter to Regional Council supporting the OMB challenge - or appear in support of it at the OMB hearing.</div>

</span></b><strong><span style="font-size: 12pt; color: black; font-weight: normal;" lang="EN">The Ontario Municipal Board (OMB) has received twenty-one appeals of the Region of Waterloo’s Regional Official Plan (ROP), including one by the Region itself. The
ROP, which for the first time contains a section on Local Health Foods, was approved by Regional Council in June 2009 but needed approval from the provincial government.

</span></strong><strong><span style="font-size: 12pt; font-weight: normal;" lang="EN">the province approved the Council-adopted ROP with several modifications on December 22, 2010.<span style="color: black;"> While many of the appeals focus on specific lands excluded
from </span>future development areas, some question the Region’s overall approach to directing
<span style="color: black;">where growth may occur. The Region’s own appeal seeks to strengthen protections for environmentally-sensitive lands as they pertain to aggregate extraction (gravel pits). </span><span style="color: red;">
