<P style="TEXT-ALIGN: justify" class=MsoPlainText><FONT size=3 face=Arial><SPAN style="FONT-FAMILY: Arial; FONT-SIZE: 12pt">As I have mentioned to you in previous correspondence, the Regional Municipality of Waterloo is responsible for municipal drinking water and the Ministry of the Environment has the lead for source water protection planning. I note that you have included both the region and Minister Gerretsen on your distribution list, so they are aware of your concerns.</SPAN></FONT></DIV>
<P style="TEXT-ALIGN: justify" class=MsoPlainText><FONT size=3 face=Arial><SPAN style="FONT-FAMILY: Arial; FONT-SIZE: 12pt"> </SPAN></FONT></DIV>
<P style="TEXT-ALIGN: justify" class=MsoPlainText><FONT size=3 face=Arial><SPAN style="FONT-FAMILY: Arial; FONT-SIZE: 12pt">The Grand River Conservation Authority (GRCA) is the local source protection authority. If you have specific concerns about the protection of drinking water in Waterloo region that you think should be considered through the source water protection planning process, please contact Laurie Minshall of the GRCA at (519) 620-7575.</SPAN></FONT></DIV>

<P style="TEXT-ALIGN: justify" class=MsoNormal><FONT size=3 face=Arial><SPAN style="FONT-FAMILY: Arial; FONT-SIZE: 12pt">You also raised concerns about avian and amphibian species at risk in the northwest area of Waterloo . As I have already outlined to you in previous correspondence, municipal planning decisions must be consistent with the Provincial Policy Statement under the <I><SPAN style="FONT-STYLE: italic">Planning Act. </SPAN></I>I have also outlined the <I><SPAN style="FONT-STYLE: italic">Endangered Species Act, 2007</SPAN></I> and the fact that it is the responsibility of the proponent to be compliant with the act or they may be subject to prosecution.</SPAN></FONT></DIV>
<P style="TEXT-ALIGN: justify" class=MsoNormal><FONT size=3 face=Arial><SPAN style="FONT-FAMILY: Arial; FONT-SIZE: 12pt"> </SPAN></FONT></DIV>
<P style="TEXT-ALIGN: justify" class=MsoNormal><FONT size=3 face=Arial><SPAN style="FONT-FAMILY: Arial; FONT-SIZE: 12pt">As Jefferson salamander are not known to occur in ESPA 19 and there does not appear to be an immediate threat to them or their habitat, my ministry is not prepared at this time to undertake a salamander study in ESPA 19 or to issue an ESA Habitat Protection Order.</SPAN></FONT></DIV>
<P style="TEXT-ALIGN: justify" class=MsoNormal><FONT size=3 face=Arial><SPAN style="FONT-FAMILY: Arial; FONT-SIZE: 12pt"> </SPAN></FONT></DIV>
<P style="TEXT-ALIGN: justify" class=MsoNormal><FONT size=3 face=Arial><SPAN style="FONT-FAMILY: Arial; FONT-SIZE: 12pt">Experts from Environment Canada have collected a great deal of data about the birds in ESPA 19 and they have concluded that the available evidence does not support the notion that this site represents important breeding habitat for any of the three identified species at risk (Acadian flycatcher, hooded warbler and redheaded woodpecker). In addition, they have indicated to my staff that they plan to continue to monitor the area.</SPAN></FONT></DIV>
<P style="TEXT-ALIGN: justify" class=MsoPlainText><FONT size=3 face=Arial><SPAN style="FONT-FAMILY: Arial; FONT-SIZE: 12pt"> </SPAN></FONT></DIV>
<P style="TEXT-ALIGN: justify" class=MsoPlainText><FONT size=3 face=Arial><SPAN style="FONT-FAMILY: Arial; FONT-SIZE: 12pt">With regard to your concerns about the protection of migratory birds in ESPA 19, as I have noted in previous correspondence, the <I><SPAN style="FONT-STYLE: italic">Migratory Birds Convention Act, 1994</SPAN></I> and its regulations are administered by Environment Canada, so you may wish to contact them<FONT color=black><SPAN style="COLOR: black">.</SPAN></FONT></SPAN></FONT></DIV>
