[All] Greenbelt, Bill 23, and Regional Planning Update with Breaking News!

Good Day,

The provincial government has introduced the legislation to restore the Greenbelt while the opposition calls for additional investigations.  There also continues to be lots of other breaking news/information.  Here’s the latest:

1) Government Introduces Greenbelt Statute Amendment Act - On Monday afternoon MMAH Minister Paul Calandra introduced the Greenbelt Statute Law Amendment Act.  The good news is that there doesn’t appear to be any surprises, obvious gaps, or sleights of hand.  The government is strengthening the Greenbelt boundaries so that hey may only be changed by future governments through legislation, not regulation which ensures proper debate, consultation, and communications.

While this is the huge victory to restore the Greenbelt that we have all worked so hard for, the media has focussed on a possible Trojan horse to the legislation - the upcoming 10 year review that was anticipated for 2025 but is expected to start much earlier.  Minister Calandra revealed a number of parameters for the Review including that it will be led by an outside, supposedly impartial panel with experts in conservation, agriculture, etc. that the Auditor General would be consulted, that it should take politics out of the process, but the Minister would not commit to not using the review to examine the 700+ requests for Greenbelt land removals.  We need to ensure that the Greenbelt is never reduced in size or subjected to land swaps.

There is a 45 day posting on the Environmental Registry of Ontario (ERO) and we need to speak up to provide feedback to the government:

There are numerous enhancements and increased protections for the Greenbelt we can ask for including:

	- eliminating the “Essential Infrastructure” provisions so that new highways and other disruptive infrastructure can’t be built in the Greenbelt,
	- prohibiting gravel mining and aggregate removal from within the Greenbelt,
	- placing agricultural easements similar to the Duffins Rouge Agricultural Lands to all prime farmland within the Greenbelt,
	- legislating that Greenbelt Reviews can only add lands, not remove them from the Greenbelt.

The opposition parties have raised concerns about this legislation containing enhanced blanket immunity protection for all government employees and elected officials so that no one can be sued or found liable for the provincial government's extremely questionable and troubling processes removing these lands from the Greenbelt.  They have also raised concerns about the need to reprimand former Minister Steve Clark, the need for more investigations, the need to strengthen the Greenbelt, the need to cancel Highway #413, the Bradford Bypass, and other Greenbelt destruction this government is still proceeding forward with.

The media has openly questioned the government’s sincerity with this Act and if after such a brutal, corrupt process doing exactly what this Bill is now trying to prevent this government can be trusted.  It was just a few weeks ago the Premier was calling the Greenbelt a “Liberal scam” and threatening to open up thousands of additional acres for development.  To quote the Toronto Star Editorial Board “this is so abrupt a reversal that Ontarians can hardly help but be bewildered, and a little suspicious.”

It could take far more than this new legislation putting back what Doug Ford tried to take from the people of Ontario to prove this government is serious about truly protecting the Greenbelt.  Here’s recent media articles on the announcement of this new Act:

4) MMAH Ultimatum to Mayors - More than 115 individuals and groups have already signed onto the excellent response letter that Hal Jaeger has prepared to respond to MMAH Minister Paul Calandra’s ultimatum to Mayors, Reeves, and Wardens across Ontario to respond and rank his checklist of Housing Affordability Task Force recommendations or face being prohibited from applying for the $1.2 billion Housing Accelerator Fund.

We think that citizens should have the opportunity to comment on the Task Force’s recommendations and offer additional suggestions too on how to address our housing affordability crisis.  A collective of concerned citizens and community groups led by the Grand River Environmental Network has prepared a response to the Minister. The Association of Ontario Municipalities (AMO) has sent a scathing letter to the province outlining all of their concerns with this ultimatum, approach and the very skewed and limited feedback choices provided by the government.  A PDF of the letter is attached below.

5) NDP Call For Las Vegas Investigation And For Premier Ford’s Cell Phone Records - The NDP Party has asked the Integrity Commissioner to look into the details of a trip to Las Vegas involving former Cabinet Minister Kaleed Rasheed as the developers in question not only were beneficiaries of Greenbelt takeouts but also several recent MZO’s.  Many aspects of the Las Vegas trip such as the dates when the trip occurred, who paid, and how it was organized is not clear:

Greenbelt Attacks Will Continue - Not to deter from our recent victory but The Centre for Urban Research and Land Development, a development funded institute at Toronto Metropolitan University, has just published a blog post calling on the 10 Year Greenbelt Review to create processes to remove lands from the Greenbelt for development:

We can expect that speculators will pressure the Ford government to use the 10-year Greenbelt review as the mechanism to take lands out of the Greenbelt and hand it over to urban sprawl developers.  We need to anticipate these attacks, stop urban sprawl, and build the affordable, sustainable housing we need.

15) What We Need To Keep Working On - Issues that we need to ensure Doug Ford’s provincial government reverses course on include:

	1) Reversing the forced sale of Conservation Authority Lands and restoring the powers/duties of our Conservation Authorities,

	2) Ensuring that Regional Planning Authority is fully returned to Waterloo, Durham, Niagara, Halton, York, Peel, and Simcoe County,

	3) Cancelling the reclassification and downgrading of Provincially Significant Wetlands and the removal of wetland offsetting policies,

	4) Repeal of the unfettered ability to expand Settlement Area Boundaries anytime, for any reason, 

	5) Ensuring the cancellation and removal of severances for farmland and rural lands with a strong “No Rural Severances” policy,

	6) Rolling back of forced urban boundary expansions in Hamilton, Waterloo, Halton, Ottawa, and elsewhere against local municipality decisions/official plans - particularly where sufficient new housing was already being accommodated within existing plans.

	7) Calling for continued investigations by the RCMP, Auditor General and Integrity Commissioner - not only into this Greenbelt Scandal but also the very similar decisions by the Ministry of Municipal Affairs and Housing that had no public input or consultation on forced urban boundary expansions, MZO’s, Growth Plan elimination, Regional Planning changes, and the wetland evaluation system changes.

	8) Continuing to fight on other key issues such as Highway #413, the Bradford Bypass, Ontario Place, Healthcare, Education, etc.
