Dear Louisette,
Good news! This morning, the Supreme Court of Canada handed down a decision that underscores the importance of protecting free expression in Canada.
Last winter, Ecojustice lawyers participated in Ontario Limited v. Pointes Protection Association, et al., and made submissions in support of a broad interpretation of Ontario’s Protection of Public Participation Act.
In our submissions, we argued that public discourse is essential to any democratic society, and environmental groups — including Ecojustice and its clients — must be able to assert their views on issues of importance without fear of being unduly dragged into lengthy and costly lawsuits aimed at silencing those views.
Today, the SCC agreed with us, and confirmed that the court will not hear such lawsuits unless the plaintiff can pass a rigorous test to show that it suffered real harm that actually outweighs the public interest in the expression of those views. The ruling upholds the purpose of Ontario’s law and will help put a stop to SLAPP-style (strategic litigation against public participation) lawsuits.
This is an important victory for all Canadians that affirms your right to participate in environmental decision-making without facing legal intimidation. Like all Supreme Court decisions, today’s ruling sets a binding precedent for all courts across the country.

On Sept. 22 and 23, Ecojustice lawyers will be back in front of the SCC to uphold the constitutionality of the Greenhouse Gas Pollution Pricing Act.
