 Hi folks

Been busy today.
I spoke with the Hamilton Police citizen review about the odd and somewhat rude conduct I had from a police officer when I visited are area of Line 10's construction. We spoke at length about the roll of police and pipeline protesters and it was an excellent discussion that resulted in a written resolution that is now with the Hamilton Police.

So Line 10 had work being done today and I took some videos to outline the various concerns here:

The function of Line 10 is to bring oil from the US to Westover through Line 9 to the east coast. The line runs through the areas with salamanders. Map is in the attachments. 
The NEB hearing outlines methods to mitigate risks to them, however they are not currently being implemented. The advised method was to use a bore hole under ground to protect potential habitat and this was to be done when the ground is frozen. It is September and the work is underway and dramatic land augmentation is evident. 
I know for a fact, the Jeffersons are in that Golf course as seen in this video. They are likely above and below that property as well. These little critters live for 35 years, can wander 5km away from ponds of birth. Critical habitat must include not only protection of their current breeding ponds but other ponds in the area for habitat expansion. 
Unfortunately for many years, the MNR in Ontario has used and promoted a method for testing for Jefferson salamanders and it involved killing them. The MNR allowed DNA testing on eggs I have a permit where 60 eggs in Hidden Valley in Kitchener,  were permitted to be collected. The eggs rotted before they got to the University of Guelph so even that testing method failed. The Toe and Tail clips can be done using drop pit traps because salamanders grow back those parts, but it has to be monitored. I've heard of critters drown in buckets because the folks doing the testing didn't put wood for the critters to climb on and when it rained they drowned. Sometimes they delay checking traps and the critters simply die in buckets. Other times I've read of folks using minnow traps to catch them, but the traps are fully submerged and they drown and other times the holes in the minnow traps are just big enough for half the body to get out, while the other half gets stuck and again, they die drowning. 
All these tests were done to determine pure breed Jeffersons aka JJ from LJ which is their hybrid varieties born from mating with blue or yellow spotted salamanders. Thanks to these testing protocols, both the pure and hybrid varieties are listed as endangered today.  Since only the pure Jeffersons mate in March, it should be a no brainer to simply observe the larger sized larvae in smaller egg clusters vs, the tiny larvae in the much larger hybrid egg clusters. I know many experts who have said the need to gather DNA to distinguish the two is absolute rubbish. 
Now here's the two for one special I'm going for right now.
Back in 2015, just before fall, Enbridge transferred assets from Enbridge Pipeline Inc. to Enbridge Income Fund Holdings Limited. It resulted in a call to the OPP and the NEB because work was under way with Line 9 and I was concerned about the permit. The permit should be in the name of the new owner. So I contacted Enbridge's Graham White to ask if Enbridge Pipeline and Enbridge Income Fund were two separate companies. He said yes but that they all fall under Enbridge Inc. 
So...if the entire hearing was focused on Line 9 being owned by Enbridge Pipeline Inc. and it wasn't the parent company, the NEB hearing should have been with Enbridge Inc. as the applicant according to the rules of the NEB.  
But...if Enbridge Pipeline Inc. was the appropriate company for the hearing, it would stand to reason that with the transfer of assets, the applicant for Line 10 hearing should have been Enbridge Income Fund Holdings not Enbridge Pipeline Inc. Why let a company who is no longer the owner, hold the permit of the pipe? 
The first time I raised this concern, the OPP bailed out of helping me (even though the officer admitted it was corrupt) because the hierarchy of the Police had Stephen Harper at the top. He gave himself discretionary powers to break all NEB rules with the first big Omnibus bill. 
But NOW...I found out that when an officer refuses to investigate...there is a CIVILIAN REVIEW BOARD...outside the control of the Prime Minister. It is an independent body that determines the conduct of the RCMP. 
On Sept 18 I did contact the RCMP. I provided them with a full binder of concerns regarding the Jefferson Salamander issues and all the irregularities of Line 10. One day after delivering this binder, I witnessed work at the site of Line 10. I went to update them on the concerns and the RCMP told me the OPP reviewed my case and it was closed. This was less than 24 hours from the time I delivered that binder.  I told the RCMP officer, I never spoke with the OPP regarding Line 10.  No OPP officer contacted me nor did I contact them. This case is a totally separate matter. The RCMP officer still refused to investigate, so I launched a formal complaint with the independent review body who is now going over the details of this case. 
If they find any flaws at all with the Line 10 pipeline process, this may have a direct impact on the supply of oil that was intended for Enbridge Line 9.  That's going to cost them. 
If they want a permit to destroy specimens or habitat range for endangered species, they have to use the Environmental Bill of Rights and it could take up to 7 years to secure the permit. The MNR has to sign off three separate times. Again that will cost. 
To follow the Endangered Species Act means they would have to do critical habitat assessment and provide net benefit for Jefferson Salamanders including expanded habitat range and replacement for the ones they harm. That costs money and if they cannot provide net benefit, that can kill this entire project. 
To wrap it all up, never underestimate the power of little details. 
No matter how big the balloon, all it takes is the head of a pin.
