I wanted to relay to Gren for their reference. Between the final arguements submitted and the actual NEB decision, the policy that shapes pipeline decisions was literally switched  from a Canadian Environmental Assessment Act process to an NEB Act Environmental Assessment as a result of Omnibis Bill 38. Is this legal?!!!

I was a delegate ot the National Energy Board hearings took place on May 24 2012 regarding Enbridge Line 9 line phase 1 flow reversal. It was a two day hearing process. http://rabble.ca/news/2012/05/enbridge-gets-mic-checked-line-9-public-hearings

Bill C-38 received Royal Assent on  June 29, 2012 and this bill augmented the legislations that government Canadian Environmental Assessment processes relating to the NEB processes.  http://laws.justice.gc.ca/PDF/C-15.21.pdf
In the attachment is a document from the National Energy Board's hearing managers dated July 27, 1012. This was the day the NEB issued their decision regarding the  Enbridge Line 9 phase 1 reversal on July 27, 2012. Note on the second page of this attachment under the section called: Regulatory Context and Highlights it states the following:
CEA Act initially triggered, but once CEA Act 2012 was enacted the Environmental Screening Report was converted to an NEB Act Environmental Assessment Report. 
As a delegate of the Line 9 phase 1 hearing process I was not reasonably notified of the legislative changes in spite of the fact I was a participant. I find it disturbing to see this change take place in between our final arguements and the NEB's decision. 
Who authorized this change? What person from what department? 
It seems unreasonable to allow a policy to simply change after final arguements have been submitted.
