Hello folks
Quick update on the situation of the tree removal in ESPA 19. Three key points for you
1. The RCMP is currently investigating the matter for possible violation of the Migratory Bird Act.2. The Canadian Wildlife Service is going to review the matter for possible violation of Endangered Species Act.3. NOT ONE SINGLE PERMIT was issued for any of this work as confirmed via written correspondence sent to me by Regional Environmental Manager Chris Gosselin. He states:
No Woodland Removal Permit was issued for clearing the walkway/utility corridor across the neck of Forested Hills E.S.P.A. because none was required.The applicable by-law governing this instance of tree cutting is By-law 08-026 (A By-law Respecting the Conservation of Trees in Woodlands). Section 3(a) of the by-law specifically exempts municipal public works such as this crossing. The relevant section of the by-law reads:“3. This By-law does not apply to:(a) activities or matters undertaken by a municipality or a local board of a municipality;”Section 135(12) of the Municipal Act requires that this exemption be included in municipal tree by-laws such as Regional By-law 08-026.
The trees were removed on public lands and chipped on the Vista Hills property so that would tell me that both the city and the developers were somehow involved with planning this activity. I have photos of the healthy trees before the cutting took place when they were first tagged. http://www.waterloomoraineact.com/treeremoval.htm
I don't know the logistics of the tagging but I assume this involves paperwork at some point. Is it the City or the Region who does the actual tagging? If there is associated paperwork on it and if so where would I look?
Does anyone know if WEEAC or EEAC involved with this tree removal process at any point? Any data I can provide to the investigators would be greatly appreciated.
