Damage to wetlands and woodlands, regardless of which side of the Countryside Line they occur, is subject to by-laws (woodlands) and regulations (filling and altering wetlands and water bodies). In the latter case, as you have pointed out, there is a six month statute of limitations during which the infractions must be detected and charges laid.

Chris and Eric (and I don't have Don C.'s email address for some reason).....by now you are aware of Kitchener's adamant refusal to honour the CSL. Carl Zehr "promised" there would be "no development " on those lands in the next 5 years. What I want to know from you is "If the property was inside the ESL CSL would there be a very large penalty for any "alterations" to the land (such as the "pond" that went missing in Doon South Activa lands) more so than if it was just sitting there outside the ESL ???
Currently destruction of a wetland has only a six month statute of limitations. If they are not reported in that time they get off Scott free,is my understanding from Samantha at GRCA. We'll see how to go about changing that law but not right now.
How protected is that land or is it just in a holding tank .? I'll be at Reg. Council tomorrow night. Ginny
