In the email underneath, is a response sent today from the Minister of Natural Resources in regards ESPA 19 in the Waterloo North West Corner. It is an area where threatened and endangered species have been confirmed for years including the Acadian Flycatcher, the Hooded Warbler and the Jefferson Salamander. 
 
Hybrid Jefferson salamanders were confirmed in ESPA 17 across the street from the Owen property in 1987 according to documents produced by the Region of Waterloo as well as reports produced by Francis and Campbell, Pennington (pers. communication) Heaton and Brown Field notes among others. To date there has yet to be any reasonable measure to properly secure a thorough Jefferson salamander survey in this area utilizing pit traps. Proper studies have taken place in regards to Hidden Valley using such methods. Testing on eggs is unacceptable since it results in loss of specimens. Pit traps allow for proper DNA analysis. We need to conduct these studies in ESPA 19 and 17 prior to any further development activities in this area if we are to comply with the Endangered Species Act.
 
The EIS reports for the West Side Lands and the Owen property confirms the fact that habitats will be degraded for area sensitive bird species. Each year the EIS took place, noisy activities during the bird breeding period as approved by the city or region included road repairs, tree removals and construction activities. I have photos and supporting documents. 
 
I would like to formally request a stop action in order to secure at least one undisturbed bird breeding survey prior to construction so that we can properly assess the function of these properties in regards to these rare species.
 
The Minister has advised I contact the Municipality and notes that it is the responsibility of the proponent to be compliant with the Endangered Species Act or they may be subject to prosecution under the act.
 
I want a written response from the City and the Region regarding this request as soon as possible.

As I have indicated to you in previous correspondence, you may wish to address your concerns about the potential impacts of development in northwest area to the City of Waterloo ’s Planning and Development Department at (519) 747-8752 or the Region of Waterloo’s Community Planning Department at (519) 575-4533. 
  
Please note that I have previously responded to you about avian and amphibian species at risk in the northwest area of the City of Waterloo . The significant habitat of endangered and threatened species is protected from development through the Provincial Policy Statement under the Planning Act. Municipal planning decisions must be consistent with the Provincial Policy Statement. 
  
The Endangered Species Act, 2007 (ESA), which came into force on June 30, 2008, identifies species at risk and protects them and their habitat. As well, the ESA promotes the recovery of the species and stewardship activities that assist in the protection and recovery of species that are at risk. It is the responsibility of the proponent to be compliant with the ESA or they may be subject to prosecution under the act.
